Please understand that if you refuse to accept these Website Terms, you will not be able to order any products from this website. And you should understand that you agree to be bound by these Website Terms by ordering products via this website.

This website is owned and operated by Huaxia Investment Limited trading as BigFoodie.co.uk.
Huaxia Investment Limited is a company registered in England and Wales with registered company number 07907582, whose registered office is at 1 Portland Street, Manchester M1 3BE United Kingdom.
Your access to, use of, placing of an order, linking to the Site, use of software or downloading software on the Site (collectively, your "Access") is conditional upon your acceptance and compliance with the terms, conditions, notices and disclaimers contained on this page and elsewhere on the Site ("Website Terms").
By accessing any part of this Website, you indicate that you accept these Website Terms.
If you do not accept these Website Terms, you must leave this Website immediately.
The Website Terms of this Site do not affect your statutory rights as a consumer.

2. Purpose
The purpose of this Site is to provide a simple, convenient and cost-effective service to bigfoodie consumers, linking them to takeaways/restaurants in their area that offer takeaway food. Interactive menus allow customers to build and submit orders at the click of a button.
By joining, members can view their takeaway order history, rate past orders, introduce friends and earn discounts.

3. Disclaimers and Limitation of Liability
To the extent permitted by law, Huaxia Investment Limited provides this Site and content on an "as-is" and "as available" basis and we make no representation or warranty of any kind, express or implied, regarding the content or availability of this Site, or that it will be timely or error-free, that defects will be corrected, or that the Site or server that makes it available are free of viruses or other harmful components.
Subject to the previous paragraph, neither bigfoodie.co.uk nor Huaxia Investment Limited directors, officers, agents, employees or contractors shall have any liability for any direct, indirect, special or consequential losses or damages (including without limitation, damages for loss of business or loss of profits), arising in contract, tort or otherwise from the use or inability to use this Site.
Nothing in these terms shall exclude or limits liability for death or personal injury resulting from our negligence or that of our agents or employees.

You may not print, copy, reproduce, download, republish, broadcast, transmit, display, modify or re-use the materials from this Site for anything other than personal, non-commercial use, including in particular any purpose which publicly re-sells or re-uses the materials, without the prior written consent of the copyright holder.

5. Indemnity
You must indemnify and hold harmless Huaxia Investment Limited, its directors, officers, employees, agents, vendors, advertisers, partners and suppliers and keep them indemnified against all loss, actions, proceedings, costs, expenses (including legal fees), claims and damages arising from your Access to and use of this Site, any breach or violation of the Terms of Use of this Site or your violation of any law or your violation of the rights of any third party.
6. Availability
This Site may be unavailable at certain times to allow for maintenance and upgrades. Although we will endeavour to notify customers in advance of any service unavailability, this cannot be guaranteed and we reserve the right to alter or withdraw the service at any time.

This Site contains links to other websites. Those websites are not under the control of Huaxia Investment Limited and Huaxia Investment Limited and bigfoodie.co.uk is not responsible for the practices, content or availability of such websites. A link does not imply endorsement of, sponsorship of, or affiliation with the linked site. We provide the links as a convenience only. If you decide to access linked third party websites, you do so at your own risk, and we will not be held responsible or liable for any loss or damages caused by use of or reliance on any contents, goods or services available on such websites.
You may provide a non-framed link to this Site from any other business or service website but not in any way which gives the impression that we are associated with or have approved such other site, unless expressly agreed to by ourselves in writing.
8. Limitations of Use
This Site is intended to be accessed by persons located in the UK and we make no representation that any information, materials or functions included in this Site are appropriate for use in any other jurisdiction.
By using this Site, you warrant that any personal information provided by you is true, accurate, current and complete in all respects and that you will notify us immediately of any changes to your personal information by updating your member profile on the Site or contacting us.
You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use.
To use our service you must be over 18 years of age.
You are not allowed to register multiple memberships for use by the same person. Violation of this clause may result in termination of your membership.
Members' passwords should be kept confidential at all times, and must not be shared or disclosed to anyone. You are responsible for all activities and orders that occur or are submitted through your membership. If you know or suspect that someone has knowledge of your password then you should contact us immediately.
You may not use the Site for any unlawful or unauthorised purpose, including without limitation:
Distributing any unlawful, libellous, abusive, threatening, harmful, obscene or otherwise objectionable material.
Transmitting material that constitutes a criminal offence, results in civil liability or otherwise breaches any laws, regulations or codes of practice.
Interfering with any other persons use or enjoyment of the Site.
Damaging, disabling or impairing the operation of this Site or attempting to gain unauthorised access to this Site or to networks connected to it, through hacking, spoofing or other such similar means.
9. Feedback and User Submissions
We do not solicit nor wish to receive any confidential or proprietary information from you. Nor do we wish to receive any creative materials, ideas or suggestions other than those we specifically request.
If you do send to us by email or otherwise, any communication or material, you represent and warrant that the information and material is original to you, and you will be deemed to have granted us a perpetual, world-wide, royalty-free license to use such communications or material in any way we see fit and we will be free to use any such material or information contained in communications you send for any purpose whatsoever.
10. Placing an order
Huaxia Investment Limited trade as bigfoodie.co.uk endeavours to deal with reputable third parties who provide a quality service, however Huaxia Investment Limited accepts no responsibility or liability for the quality or quantity of any goods delivered by or collected from said third parties. It is the responsibility of the customer to thoroughly check the supplied goods before agreeing to pay for an order.
All questions regarding goods shown on this Site should be directed to the partner takeaway/restaurant.
After you submit an order to us, we will send you order confirmation by email with order details. Should you find any information on the order confirmation is not what you expected, you can either contact us or cancel the order immediately. For the details of how to cancel an order please refer to Cancellation below.
Please make sure the email address you provide is correct and your mailbox is in proper working order, as all correspondence regarding your order is sent to this address.
All food preparation and deliveries are the sole responsibility of the takeaway/restaurant accepting the order. Please be aware that the takeaway/restaurant will do everything they can to meet the delivery time you specified, however delivery times may be affected by factors beyond their control and therefore cannot be guaranteed. We will inform you if we become aware of an unexpected delay. You can select ‘As Soon As Possible’ in the delivery time frame drop list, subject to the distance, traffic condition, weather condition etc, this would normally mean you should expect the order to be delivered within 45-60 minutes once you complete the order process.
Incorrect personal details may lead to problems or delays in delivery, so please ensure that you have included your correct address (including postcode), email address and contact telephone number when ordering.
Members can track the progress of their orders by viewing their Order History.
A. Alcohol and Cigarettes
Pursuant to the Licensing Act 1964, it is an offence for any person under the age of 18 to buy, or attempt to buy, intoxicating liquor, or for any person over the age of 18 to buy intoxicating liquor on behalf of any person under the age of 18. Cigarettes are not for sale to minors under the age of 16. Orders containing either alcohol or cigarettes can therefore not be accepted from minors.
B. Payment
Once your order has been accepted, this represents an agreement between you the customer and the takeaway/restaurant. The takeaway/restaurant has sole responsibility for this order. Cash payments are made directly to the takeaway/restaurant fulfilling the order. If you have chosen to pay with credit or debit card on the Site then the transaction is processed by Huaxia Investment Limited trade as bigfoodie.co.uk as an authorised agent of the takeaway/restaurant.
All prices quoted are in British (Sterling) Pounds.
Delivery and/or service charge are calculated per order and based on the policy of the individual takeaway/restaurant. Any delivery charges or service charges will be displayed clearly in your Order Summary.
Prices are subject to change and all goods are subject to availability.
C. Cancellation
You have the right to cancel an order up to the point the order is prepared by the takeaway/restaurant. Normally, this is approximately 45 minutes before the time you requested delivery or collection of the order.
We might still refund you even after the order being delivered. However this will only happen at the consent of takeaway/restaurant.
In a rare situation where the quality of food or delivery service is not entirely at your satisfaction or expectation, you are advised to call takeaway/restaurant directly within 48 hours after receive your order for refund or compensation. You might also choose to contact bigfoodie and we are willing to act as assistance to communicate your concern with the takeaway/restaurant. A decision will be made and communicated to you within 48 hours after receive your enquery.
Members can cancel an order via their Order History, while guests can call the takeaway/restaurant to cancel an order.
While every effort is made to ensure that accurate pricing and descriptions are maintained, we reserve the right to cancel any order that is based on inaccurate information.
An order may be subsequently cancelled by a takeaway/restaurant after you have received an email or phone call informing the order has been accepted. Huaxia Investment Limited trade as bigfoodie.co.uk and our partner takeaways/restaurants reserves the right to cancel any order, before or after acceptance, and will notify you immediately of any such cancellation.
11. Customer Ratings
The ratings contained on this Site are for informational purposes only and do not constitute advice. Nor should you rely on ratings to make (or refrain from making) or take (or refrain from taking) any action. Ratings are the opinions of customers who have ordered through the Site, and any statements, advice or opinions made by such customers are those of such customers only.
12. Termination
We reserve the right to decline a new registration, terminate your right to link to the Site, remove you as a user of this Site, and/or prevent any further use if you violate any of the Terms of Use. If we consider there to be a risk of liability or loss to us or our partner takeaways/restaurants we may take any action deemed necessary to prevent such a liability or loss from occurring.
If we terminate your right to link to the Site you must cease linking to the Site immediately. Any person who holds a suspended or terminated membership must not order from or re-join this Site without our prior written consent. We reserve the right to assign or sub-contract any or all of our rights and obligations under these terms.
Please note that we have the ability to trace your IP address, and if necessary, contact your ISP in the event of a suspected breach of these Terms of Use.
13. Enforceability
If any part of these Terms of Use are deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of any of the remaining provisions of these Terms of Use.
No waiver by us shall be construed as a waiver of any preceding or succeeding breach of any provision.
14. Governing Law
The Terms of Use, Privacy Policy and any matter relating to this Site shall be governed by English law and any dispute shall be resolved exclusively in the courts of England.

  • INFORMATION THAT WE COLLECT FROM YOU
    1. As part of our commitment to the privacy of our customers and visitors to our Sites more generally, we want to be clear about the sorts of information we will collect from you.
    2. When you visit the Sites or make an order through the Sites, you are asked to provide information about yourself including your name, contact details, delivery address, order details and payment information such as credit or debit card information.

If you contact us by phone, we record the call for training and service improvement purposes, and make notes in relation to your call.
    4. We collect technical information from your mobile device or computer, such as its operating system, the device and connection type and the IP address from which you are accessing our Sites.
    5. We also collect technical information about your use of our services through a mobile device, for example, carrier, location data and performance data such as mobile payment methods, interaction with other retail technology such as use of NFC Tags, QR Codes and/or use of mobile vouchers. Unless you have elected to remain anonymous through your device and/or platform settings, this information may be collected and used by us automatically if you use the service through your mobile device(s) via any Bigfoodie mobile application, through your mobile's browser or otherwise.
    USE OF YOUR INFORMATION
    1. We will only process the data we collect about you if there is a reason for doing so, and if that reason is permitted under data protection law. We will have a lawful basis for processing your information: if we need to process your information in order to provide you with the service you have requested or to enter into a contract; we have your consent; we have a justifiable reason for processing your data; or we are under a legal obligation to do so.
    2. Where we need to in order to provide you with the service you have requested or to enter into a contract, we use your information:
  • to enable us to provide you with access to the relevant parts of the Sites;
  • to supply the services you have requested;
  • to contact you where necessary concerning our services, such as to resolve issues you may have with your order.
  • 3. We also process your data where we have a justifiable reason for doing so— for example personalisation of our service, including processing data to make it easier and faster for you to place orders. We have listed these reasons below:

  • COOKIES
    On occasion, we may gather information about your computer for our services and to provide statistical information regarding the use of our website to our advertisers. Such information will not identify you personally it is statistical data about our visitors and their use of our site. This statistical data does not identify any personal details whatsoever. Similarly to the above, we may gather information about your general internet use by using a cookie file. Where used, these cookies are downloaded to your computer automatically. This cookie file is stored on the hard drive of your computer as cookies contain information that is transferred to your computer's hard drive. They help us to improve our website and the service that we provide to you.
    All computers have the ability to decline cookies. This can be done by activating the setting on your browser which enables you to decline the cookies. Please note that should you choose to decline cookies, you may be unable to access particular parts of our website. Our advertisers may also use cookies, over which we have no control. Such cookies (if used) would be downloaded once you click on advertisements on our website.

  • We share your information with other bigfoodie group companies only where necessary for the purposes set out in section 4.

    We share your information with third party service providers. The types of third party service providers whom we share your information with includes:
  • Payment providers (including online payment providers and fraud detection providers): for the purposes of providing services to us, for example when they process information such as credit card payments for us, provide support services to you or carry out fraud checks for us;
  • IT service providers (including cloud providers): for the purposes of data storage and analysis;
  • Restaurant partners: that you have placed your order with so that they can fulfil your order, be made aware of any food allergies you have volunteered to tell them about, resolve issues, or improve their services;
  • Riders: so they can deliver your order to you;
  • Customer support partners: who will help us to resolve any issues you may have with our services; and
  • Marketing and advertising partners: so that they can ensure that you see advertising which is more relevant to you and send you email marketing on our behalf.
  • Bigfoodie will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy policy when it is transferred to third parties.
    4. If our business enters into a joint venture with, purchases or is sold to or merged with another business entity, your information may be disclosed or transferred to the target company, our new business partners or owners or their advisors.
    5. We may also share your information:
  • if we are under a duty to disclose or share your information in order to comply with (and/or where we believe we are under a duty to comply with) any legal obligation or regulatory requirement. This includes exchanging information with other companies and other organisations for the purposes of fraud protection and prevention;

  • to protect the rights of Bigfoodie, restaurant partners, riders, or others, including to prevent fraud; and
  • with such third parties as we reasonably consider necessary in order to prevent crime, e.g. the police.
  • 6. International transfers of data
  • In some cases the personal data we collect from you might be processed outside the European Economic Area ("EEA"), These countries may not have the same protections for your personal data as the EEA has. However, we are obliged to ensure that the personal data that is processed by us and our suppliers outside of the EEA is protected in the same ways as it would be if it was processed within the EEA. There are therefore certain safeguards in place when your data is processed outside of the EEA.

    1. We adopt robust technologies and policies to ensure the personal information we hold about you is suitably protected.
    2. We take steps to protect your information from unauthorised access and against unlawful processing, accidental loss, destruction and damage.
    3. Where you have chosen a password that allows you to access certain parts of the Sites, you are responsible for keeping this password confidential. We advise you not to share your password with anyone.

    4. The right to rectification. You are entitled to have your information corrected if it is inaccurate or incomplete. You can request that we rectify any errors in information that we hold by contacting us.
